This is a question we get asked almost as often as "Why don't you sell Kratom Capsules?" The simple answer is indeed quite simple: It's not currently legal to sell Kratom Capsules anywhere in the world.
Then why are there so many companies selling Kratom Capsules?
It's simple: They're simply cashing in on something while they can, flouting the law, and taking on a lot of risk, typically at the customer's expense, in order to make as much money as possible in the shortest amount of time possible. This is sad, but true. It's that, or the company selling those capsules is simply ignorant of the law.
That's part of what makes BuyKratom so different; we know the law, and we know exactly what we need to do in order to operate within it.
There is a 100% legitimate and legal market for Kratom products, for use in research, as botanicals, or as a component of incense blends or aromatherapy. That's exactly how we offer our Kratom products. The moment someone puts this botanical into a capsule, it creates confusion for the customer (who assumes they can consume the product, otherwise why would the Kratom be in a capsule?), and it also counts as a misbranded product in the eyes of the FDA.
The laws in the United States regarding dietary and herbal supplements is quite clear: If an herbal product was not commercially available before 1994, then it is not considered "GRAS" (Generally Regarded As Safe) in the United States. That means any new herb being introduced into the market needs to go through an application process with the FDA, called an "NDI". NDI simply stands for "new dietary ingredient". There are no known NDI's for Kratom, therefore, no Kratom products can be sold as herbal supplements. Anyone selling encapsulated Kratom is not following the law, and their product can be seized, their manufacturing or retail facility shut down, and customer records seized.
We have no desire to put ourselves at that kind of risk, nor do we have any desire to put our customers at risk. One recent example of the FDA enforcing this simple law, can be seen in a recent string of arrests in Tennessee. A product called "Vico Zen" by Experience Alternatives that contains Kratom was being sold as a dietary supplement. No product containing Kratom can be sold as a dietary supplement. Also, this product was being sold in Tennessee, where Kratom is currently illegal.
As a result, the shop selling the product was shut down. The company selling the product faces a minimum fine of $100,000.00 and is subject to a very public Warning Letter from the FDA. Also, the company is forced to do a recall of their product, refunding any product that gets returned to them, including shipping costs.
What's perhaps most ironic about all of this, is that capsules are an extremely ineffective way to ingest Kratom in the first place. Theoretically speaking, Kratom relies on the entire dose to be absorbed into a bodily system at the same time to be effective. Capsules delay and stagger the absorption of Kratom, therefore weakening the intended effect. That means far more capsules than would otherwise be needed would need to be consumed in order to have the same results as consumption of the raw powder or an extract.
But, that is all theoretical, as we do not advocate the consumption of Kratom, especially Kratom that's been placed into a capsule. Protect yourself from any sort of consequences, and buy your Kratom products from online vendors who sell Kratom for legitimate purposes, and who sell if responsibly on their websites just as we do. Yes, we're very strict in our rules, and if we even THINK a customer is going to consume any Kratom product we offer, we will lock your account and block you from further transactions.
This may seem like a harsh measure, but those who understand it's for our safety as well as yours, are grateful that we're such sticklers for the law. So, you'll never find Kratom capsules here at BuyKratom.com, and for very good reason. We want to offer Kratom products for a long time to come, and the best way to do that is to operate our shop within the very clear letter of the law.
